ALLGEMEINE GESCHÄFTSBEDINGUNGEN Gerner Electronics, Anton-Gilch-Str. 6, 94526 Metten § 1 Geltungsbereich, Kundeninformationen Die folgenden Allgemeinen Geschäftsbedingungen regeln das Vertragsverhältnis zwischen Gerner Electronics und den Verbrauchern und Unternehmern, die über unseren Web-Shop Waren kaufen. Diese AGB beinhalten weiterhin Kundeninformationen nach der BGB-Infoverordnung. Die Vertragssprache ist Deutsch. § 2 Vertragsschluss Durch Bestellung im Internet, das Absenden einer schriftlichen Bestellung außerhalb des Internets oder eine telefonische Bestellung von Waren unterbreitet der Besteller gegenüber der Gerner Electronics, Anton-Gilch-Str. 6, 94526 Metten ein Angebot zum Abschluss eines Kaufvertrages. Der Vertrag kommt durch Lieferung der Ware durch die Gerner Electronics zustande, soweit die Lieferung innerhalb von 10 Tagen nach dem Absendedatum des Angebots erfolgt.. § 3 Kundeninformation: Speicherung des Vertragstextes Wir speichern den Vertragstext mit Angaben zum gekauften Artikel auf unseren Systemen, die für Sie nicht zugänglich sind. § 4 Rücksendekosten im Fall des Widerrufs Verbrauchern steht ein gesetzliches Widerrufsrecht zu (siehe Widerrufsbelehrung). Die Kosten des Rückversandes trägt der Käufer. § 5 Eigentumsvorbehalt Der Kaufgegenstand bleibt bis zur vollständigen Bezahlung unser Eigentum. § 6 Verjährung Ihrer Gewährleistungsansprüche (1) Gewährleistung gegenüber Verbrauchern bei Ersatzteilen bzw. Verschleißteilen Ihre Gewährleistungsansprüche wegen Mängel bei Ersatzteilen u. Verschleißteilen verjähren in einem Jahr ab Übergabe der verkauften Sache an Sie. Von dieser Regelung ausgenommen sind Schadensersatzansprüche, Ansprüche wegen Mängel, die wir arglistig verschwiegen, und Ansprüche aus einer Garantie, die wir für die Beschaffenheit der Sache übernommen haben. Für diese ausgenommenen Ansprüche gelten die gesetzlichen Verjährungsfristen. (2) Gewährleistung gegenüber Unternehmern Ihre Gewährleistungsansprüche wegen Mängel der Kaufsache verjähren in einem Jahr ab Gefahrübergang. Von dieser Regelung ausgenommen sind Schadensersatzansprüche, Ansprüche wegen Mängel, die wir arglistig verschwiegen, und Ansprüche aus einer Garantie, die wir für die Beschaffenheit der Sache übernommen haben. Ebenfalls ausgenommen ist der Rückgriffsanspruch nach § 478 BGB. Für diese ausgenommenen Ansprüche gelten die gesetzlichen Verjährungsfristen. § 7 Haftungsbeschränkung Wir schließen die Haftung für leicht fahrlässige Pflichtverletzungen aus, sofern diese keine vertragswesentlichen Pflichten, Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit oder Garantien betreffen oder Ansprüche nach dem Produkthaftungsgesetz berührt sind. Gleiches gilt für Pflichtverletzungen unserer Erfüllungsgehilfen und unserer gesetzlichen Vertreter. Zu den vertragswesentlichen Pflichten gehört insbesondere die Pflicht, Ihnen die Sache zu übergeben und Ihnen das Eigentum daran zu verschaffen. Weiterhin haben wir Ihnen die Sache frei von Sach- und Rechtsmängeln zu verschaffen. § 8 Kaufmännischer Gerichtsstand Ausschließlicher Gerichtsstand für alle Streitigkeiten aus diesem Vertrag ist unser Geschäftssitz, wenn Sie Kaufmann sind. of application, customer information The
following General Terms and Conditions of Trade regulate the contractual
relationship between Gerner Electronics and the consumers and
entrepreneurs who purchase our goods via this online store. These
GTCT contain additional customer information according to the Regulation
on Information and Documentation pursuant to the German Civil Code. The
language of contract is German. § 2
Conclusion of contract (1) Conclusion of contract for
fixed-price items a) By
listing an item on our online store, we make a binding offer to conclude a
contract of sale for this item. b) The
contract is concluded if you accept the general terms of our company.
§ 3
Customer information: Storage of the text of the contract
We store
the text of the contract with information about the item purchased on our
systems, which are not accessible to you.
§ 4
Return shipping expenses in the event of
cancellation Consumers
have a statutory right of cancellation (see cancellation policy). However,
you must only pay the normal return shipping expenses. We are responsible
for additional expenses incurred, e.g., due to a change in our business
location or because we request the use of more expensive transport
services. § 5
Reservation of ownership The
object of purchase remains our property until receipt of payment in full.
§ 6
Limitation of your warranty claims (1)
Consumer warranties on used goods Your
warranty claims due to defects in spare parts shall lapse one year after
delivery of the object of sale to you. Claims for restitution of damages,
claims due to defects that we fraudulently concealed, and claims due to
the lack of a warranted property of the object shall be exempt from this
provision. For these exempted claims, the statutory periods of limitation
shall apply. (2)
Warranties in relation to
entrepreneurs Your
warranty claims due to defects in the object of sale shall lapse one year
after the transfer of risk. Claims for restitution of damages, claims due
to defects that we fraudulently concealed, and claims due to the lack of a
warranted property of the object shall be exempt from this provision.
Claims under a right of recourse pursuant to Section 478 German Civil Code
are likewise exempt from the above provision. For these exempted claims,
the statutory periods of limitation shall apply.
§ 7
Limitation of liability We shall
not be liable for ordinarily negligent breaches of obligation unless these
pertain to essential contractual obligations, damages arising from
wrongful death, personal injury or injury to health or warranties or
claims pursuant to the Product Liability Act are affected. The same shall
apply for breaches of obligation on the part of our vicarious agents and
legal representatives. In particular, the essential contractual
obligations include the obligation to deliver the object to you and allow
you to own it. Furthermore, we are obligated to deliver the object to you
free of material and legal defects. § 8 Legal
venue for dealings with merchants If you
are a merchant, the exclusive legal venue for all disputes arising from
this contract is our business location. Right of
cancellation
You are
entitled to cancel your declaration of contract within one (1) month in
writing (e.g. by letter, fax, e-mail) without stating a reason or – if the
object has been handed over to you prior to expiration of this period – by
returning the object. The period of time commences after receipt of this
information in written form, however not prior to receipt of the objects
by the recipient (in the case of recurrent delivery of similar goods not
prior to receipt of the first partial delivery), and not prior to
compliance with our obligation to provide information in accordance with
section 246 sub-section 2 in conjunction with sub-section 1 par. (1) and
(2) EGBGB (Introductory Act to the German Civil Code) and our obligations
in accordance with the first sentence of sub-section 1 of section 312e BGB
(German Civil Code), in conjunction with section 246 sub-subsection 3
EGBGB. In order to comply with the period available for cancellation, it
is sufficient to dispatch the notice of cancellation or the goods in due

of cancellation In the
event of effective cancellation, the goods and services as well as
payments received by the parties shall be returned and any benefits
enjoyed (e.g. interest) shall be surrendered. In the event that you are
unable to return the goods or services received in full or in part, or if
you are able to return them in deteriorated condition only, you may be
obliged to make compensation for lost value. This does not apply to the
delivery of objects if the deterioration of such goods is exclusively due
to their inspection - as would have been possible for you, for example, in
a retail shop. If the deterioration of the goods results from putting them
to use in accordance with their intended purpose, you are not obliged to
make compensation for lost value. Objects that may be dispatched by
package/parcel are to be returned at our risk. The return of the goods is free of
charge for you. Objects that cannot be dispatched by package/parcel will
be collected from your address. Obligations concerning the reimbursement
of payments have to be fulfilled within 30 days. For you, the term
commences upon the dispatch of your notice of cancellation or of the
object, for us it commences upon receipt of your notice of cancellation or
